This is the last Will and Testament of me WILLIAM HARBAGE of Wardington in the County of Oxford Farmer I give and devise my house at Wardington in the occupation of JOHN DUMBLETON unto my son JOHN HARBAGE his heirs and assigns for ever  I also give and devise my three freehold closes called Archers Grounds situate in the parish of Wardington aforesaid unto my said son JOHN HARBAGE his heirs and assigns forever subject nevertheless to the mortgage debt thereon owing to WILLIAM ROOT of Edgcott   I give devise and bequeath my leasehold estate containing about thirty six acres situate at Chacombe in the County of Northampton and now in my own occupation unto my son WILLIAM HARBAGE for his own absolute use and benefit  And whereas my late father JOHN HARBAGE by his last Will and Testament devised and bequeathed all his residuary freehold and leasehold messuages lands tenements and hereditaments to my brother JOHN HARBAGE his heirs executors administrators and assigns upon trust by the ways and means therein mentioned to raise and pay or provide for the payment of the several legacies and annuities therein bequeathed and subject thereto In trust for me for life and after my decease In trust for my son JOSEPH HARBAGE his heirs executors administrators and assigns And whereas I have paid and discharged the said several legacies Now I do hereby declare that the said residuary freehold and leasehold messuages lands tenements and hereditaments so devised by the Will of my Father aforesaid shall go to and be held by said son JOSEPH HARBAGE his heirs executors administrators and assigns discharged of all claims and demands in respect of the legacies so paid and discharged by me as aforesaid  I give devise and bequeath my lifehold close called Heritages Close situate at Wardington aforesaid and now in my own occupation and all the Residue of my real and personal estate whatsoever and wheresoever unto my said Brother JOHN HARBAGE and JOHN JONES of Middleton Cheney in the County of Northampton Farmer their heirs executors administrators and assigns Upon trust to sell my said lifehold Close and real estate together or in parcels and by public auction or private contract with full liberty to buy in the same when offered to public sale and to rescind or vary any contracts for the sale thereof and to sell and convert into money my said personal Estate and to stand possessed of the moneys to arise from the sale and conversion of my said lifehold close and my said residuary real and personal Estate after payment of my debts and funeral and testamentary expenses In trust for my said sons JOHN HARBAGE  WILLIAM HARBAGE and JOSEPH HARBAGE to be equally divided between them share and share alike provided and I do hereby declare that my said sons JOHN HARBAGE shall have the right to purchase and take to my said lifehold close the sum of seven hundred pounds provided he notify in writing made his hand to my said trustees his intention to do so within four calendar months after my decease but I declare that no purchaser shall be bound to take notice of this right of preemption given to my said son JOHN And I declare that the receipts of my said trustees to purchasers and others for moneys paid to my said trustees shall be sufficient discharges for the same and from all liability to see to the application thereof And I empower my trustees to retain and allow to each other the costs and expenses incurred in the execution of the trusts of this my Will or in relation thereto and I delcare that one of them not be answerable for the other of them but each for his own acts deeds and defaults only  And I appoint the said JOHN HARBAGE (my Brother) and the said JOHN JONES Executors of my this my last Will and Testament

In witness whereof I have hereunto set my hand this third day of March one thousand eight hundred and forty three – WILLIAM HARBAGE – Signed and acknowledged by the said WILLIAM HARBAGE the Testator as his last Will and Testament in the presence of us present together at the same time who at his request in his presence and in the presence of each other have subscribed our names at witnesses the words “their heirs executors administrators and assigns” having been interlined in between the third and fourth line from the bottom of the first sheet – WILLIAM MUNTON Banbury – THOMAS HIRONS HARBAGE Ratley Warwickshire

This is a Codicil to the last Will and Testament of me WILLIAM HARBAGE of Wardington in the County of Oxford Farmer which Will is dated the third day of March one thousand eight hundred and forty three  I revoke my said Will so far the same is altered by this my Codicil but in all other respects I ratify and confirm the same  I bequeath the bed on which I have been accustomed to lie and my best bedstead and the furniture thereto belonging unto my son JOHN HARBAGE and I direct my trustees in my said Will named to divide the residue of my household furniture plate linen china and other household effects equally between my sons JOHN HARBAGE  JOSEPH HARBAGE and WILLIAM HARBAGE in such manner as my same trustees shall think fit  And I give devise and bequeath my lifehold close called Heritages situate at Wardington aforesaid unto my said son JOHN HARBAGE for his own absolute use and benefit subject nevertheless to the payment of the sum of four hundred pounds now secured on mortgage of the same And I direct my trustees by and out of the moneys to arise from the sale and conversion of my residuary real and personal estate to pay the sum of one hundred and fifty pounds to my said son WILLIAM HARBAGE to whom I do hereby give and bequeath the same and I direct the same to be paid to him at the expiration of twelve calendar months from my decease but without interest in the meantime and I declare that my sister MRS LETTS shall have and take the household goods and furniture and other effects in and about my dwellinghouse which belong to and are claimed by her and that my said trustees and legatees shall not dispute her right thereto

Proved at London with a Codicil 13th June 1845 before the Judge by the oaths of JOHN HARBAGE the Brother and JOHN JONES the Executors to whom Admon was granted having been first sworn by Commission duly to administer
