This is the last Will and Testament of me SARAH BARFORD the Wife of HUGH BARFORD of Henley upon Thames in the County of Oxford Maltster Whereas by Indentures of Lease and Release bearing date on or about the fourteenth and fifteenth days of September in the year one thousand eight hundred and twenty eight and made between the said HUGH BARFORD of the first part me the said SARAH BARFORD by my then name of SARAH SMITH Spinsters of the second part and TILLEMAN HODGKINSON BOBART and CHARES HOUSE of the third part being the Settlement made on the marriage then about to be solemnized between me and my said Husband the sum of one thousand pounds sterling [secured] by a certain Bond or Obligation in the said Indenture mentioned and a certain messuage or tenement with the appurtenances situate in Hart Street in Henley upon Thames aforesaid in the said Indenture particularly mentioned assignes conveyed and assured and became vested in the said TILLEMAN HODGKINSON BOBART and CHARLES HOUSE upon the following trusts (that is to say) From and after the solemnization of the marriage then agreed on between us Upon Trust for such person or persons and for such estate and estates interest and interests and in such parts shares and proportions and chargeable and charges in such manner and form in all respects as I the said SARAH BARFORD by any Deed or Deeds in writing by me sealed and delivered in the presence of and attested by two or more credible witnesses or by my last Will and Testament in writing or any Codicil thereto or any writing in the nature of a Will or Codicil by me signed and published in the presence of and attested by a like number of witnesses should notwithstanding my coverture or whether I should be under coverture or not give direct or appoint And in default of [ ] such gift direction or appointment upon Trust during my natural life to pay the interest rents and profits thereof as the same should be received unto me the said SARAH BARFORD for my sole and separate use And from and after my decease in default of any such gift direction or appointment and so far as any such should not extend upon Trust as to the said principal sum of one thousand pounds and the interest thereof for such person or persons exclusive of my said Husband as at the time of my decease should by my next of kin in case I had died unmarried and intestate And as to the said freehold messuage or tenement To the use of or in trust for such person and persons who should be my heir or heirs at law at the time of my decease his or their heirs and assigns for ever And whereas the said principal sum of one thousand pounds hath [ ] since been paid off and is now invested in the sum of one thousand pounds three pounds five shillings per cent Annuities Now I the said SARAH BARFORD by virtue of the power and authority given and reserved to me by the said Indenture and of all other powers and authorities enabling me in this behalf Do by this my last Will and Testament signed and published in the presence of two credible witnesses direct and appoint that the Trusts for the time being of the said sum of one thousand pounds Three pounds five shillings per cent Annuities and of the said messuage or tenement so vested in them as aforesaid shall from and immediately after my decease in case my Husband the said HUGH BARFORD shall survive me stand seized and possessed thereof upon Trust to pay the interest dividends rents and profits thereof unto my Husband the said HUGH BARFORD for the term of his natural life for his own use and benefit And from and after his decease then as to the said sum of one thousand pounds three pounds five shillings per cent Annuities and also the said messuage or tenement upon Trust for such person or persons and in such shares and proportions and in such manner and form in all respects as would be entitled to the same under the limitations and provisions of the said Indenture of Settlement in case I had died unmarried and intestate I appoint my Husband the said HUGH BARFORD sole Executor of this my Will I revoke all other Wills and Testamentary Dispositions by me at any time heretofore made and declare this to be my last Will and Testament In witness whereof I the said SARAH BARFORD the Testatrix have to this my last Will and Testament contained in two sheets of paper set my hand this twenty sixth day of April in the year of our Lord one thousand eight hundred and fifty one – X – The Mark of SARAH BARFORD – Signed by the above named Testatrix SARAH BARFORD as and for her last Will and Testament in the presence of us who in her presence and in the presence of each other have subscribed our names as witnesses – SAML. Proved at London 29 th Octr. 1851 before the Judge by the Oath of HUGH BARFORD the Husband the sole Executor to whom Admon was granted limited so far only as concerns the right title and interest of the Deceased in and to all such Personal Estate and Effects as she the said Deceased by virtue of a certain Indenture bearing date the 15 th September 1828 has a right to appoint or dispose of and hath in and by her said Will appointed or disposed of accordingly but no further or otherwise he having been first sworn (by Commission) duly to administer
